Driving under the influence charges may follow hospital release

A driver of a sedan who allegedly caused a crash may face criminal charges upon his discharge from the hospital. The California Highway Patrol suspects the 22-year-old driver was driving under the influence of alcohol. The date of his release from the medical facility is not clear.

According to an accident report, the Santa Rosa man was eastbound on Highway 12 in a sedan on a recent Tuesday evening. At a spot where the CHP says the eastbound lanes have a slight dip, the view of westbound traffic can be briefly obscured. This was where the eastbound driver decided to pass another car. Reportedly, he crossed the double yellow lines in the center, putting him in the westbound lanes. He headed directly for a 59-year-old driver in a pickup truck who apparently tried to take evasive action but failed.

The wreck that followed reportedly caused serious injuries to both drivers. CHP officers say they could smell alcohol on the breath of the younger driver who crossed into the westbound lanes. After obtaining a warrant, his blood was drawn for toxicology tests before he was hospitalized with serious injuries.

When a California driver is expecting a charge for driving under the influence, it may be wise to seek skilled legal counsel even before the arrest. An experienced DUI defense attorney can assess the circumstances of the accident and prepare the client for what will follow. A lawyer can advocate on behalf of the driver during interviews and interrogations, and prevent the driver from making self-incriminating statements. Based on the available evidence, a skilled attorney will work to achieve the best possible outcome.
