2nd crash allegedly killed driver in wreck, DUI charge pending

A 24-year-old California man who was critically injured may not even be aware that he could be arrested upon his release from the hospital. A spokesperson for the California Highway Patrol said the man might face a DUI charge. This follows a crash that occurred in San Mateo in the early hours of a recent Saturday morning.

According to an accident report, CHP says a 54-year-old woman traveled south on a local highway shortly after 3 a.m. when she failed to maintain control of her vehicle. Officers say the road was wet from persistent raining, and she slammed into the divider on the center median. Her car came to a halt facing west.

The suspected drunk driver then failed to avoid the crashed car and smashed into the already present wreck. The woman driver died at the accident scene, and emergency workers rushed the man to an area hospital for treatment of major injuries. CHP says preliminary crash investigations indicate that the woman might have survived the crash into the center divider and only died after the second vehicle smashed into her car.

When this driver has recovered sufficiently and learns that he might be facing a DUI charge, he will likely consider his defense options. To disprove the allegations that he and not the initial crash caused the woman's death may be challenging.
