Passenger's death leads to manslaughter and DUI charge for driver

Going up against the zero-tolerance California DUI laws is not easy. A conviction on a DUI charge can mean time in jail, fines, job loss and other adverse consequences. For those accused of causing a fatal accident, a conviction can come with dire consequences.

A 22-year-old Fallbrook resident is in custody awaiting further proceedings after he allegedly caused a crash that claimed the life of his passenger. According to an accident report, the driver lost control of his car when he went into a curve on a road in Anza, causing the vehicle to roll over. The California Highway Patrol reported that the incident occurred shortly before midnight on a recent Sunday.

The 22-year-old passenger, a man from Escondido, did not survive the accident. The driver was taken to a nearby hospital for treatment of unknown injuries. According to allegations made by CHP, the man's failure to negotiate the curve was due to his level of intoxication; however, no mention was made of the driver's blood alcohol level.

Upon his release from the hospital, the driver was arrested on a DUI charge and for gross vehicular manslaughter. With the help of an experienced California DUI defense attorney, the validity of any warrant obtained by law enforcement personnel for chemical tests and the process of any testing to determine his blood alcohol content can be evaluated. Variations from accepted protocol can be addressed by motion before the criminal court. An attorney will focus on a defense strategy designed to achieve the best possible result.
