Vehicular manslaughter may be added to DWI charge after son dies

A 31-year-old father is not only mourning the death of his son, but he may also be facing a vehicular manslaughter charge related to a crash in which his son died. Defending a DWI charge can be complicated and are typically best handled by an experienced attorney. A report by the California Highway Patrol indicates that the fatal accident occurred in Angels Camp in the early evening of a recent Tuesday.

The 31-year-old Jackson man was reportedly southbound on a local roadway at approximately 30 mph. He allegedly failed to control his car as he entered a curve. After leaving the road on the right, he apparently overcorrected and swerved sharply left. This caused the vehicle to go into a counterclockwise spin across the roadway, ultimately smashing into a tree.

Although the driver's 4-year-old son was in a child seat, it is not clear whether he was buckled in. The father and his son were airlifted to different hospitals -- the adult with minor injuries and the child with critical injuries. Sadly, the boy succumbed to his injuries. The initial arrest of the driver was on suspicion of drunk driving and child endangerment, but officials said a vehicular manslaughter charge might be added following the death of his son.

Navigating the defense of a DWI charge is a complicated task, especially if a fatal accident resulted in the death of a child. Having an experienced drunk driving defense attorney on his side will likely be crucial for this California man. After assessing the circumstances of the accident, the details of the charges and the procedures used to determine the driver's level of intoxication, a lawyer will prepare a defense strategy focused on pursuing the best possible outcome.
