Yuba County crash will leave driver defending a DWI charge

A 31-year-old California man lost his life in a crash in Yuba County on a recent Saturday evening. The driver of the vehicle was transported to a hospital for treatment of minor injuries. A DWI charge is apparently pending, as authorities reported that he will be arrested upon his release from the hospital. He will also be charged with vehicular homicide.

The California Highway Patrol report indicates that a 28-year-old Pike resident and two passengers were northbound on Highway 49 in a pickup truck when the driver lost control of the vehicle on a curve. The pickup crashed after leaving the roadway, traveling about 300 feet down a steep embankment. One of the passengers, who suffered only minor injuries, was able to get back to the road to get help from another motorist.

Although first responders performed CPR on the critically injured passenger, he succumbed to his injuries at the accident scene. CHP revealed that the driver's license had been suspended on a previous occasion when he apparently refused to submit to a blood alcohol test. Although no mention is made of his blood-alcohol content at the time of this crash, he is expected to be booked into the county jail on DWI charges.

Defending a DWI charge effectively may be best accomplished with the guidance and support of an experienced California drunk driving defense attorney. A lawyer can assess the charges and scrutinize the legality of the procedures followed by officers during the arrest and the determination of the driver's level of intoxication. The burden of proof is on the prosecutors, and unless this driver's guilt is proved in court and beyond a reasonable doubt, he will remain innocent in the eyes of the law.
