DUI charge follows death of man fixing a flat tire

A California resident from San Francisco is in jail in lieu of $175,000 bail after his arraignment on a recent Thursday afternoon. This followed an accident on Interstate 880 in which another motorist lost his life. The man is facing a DUI charge along with vehicular manslaughter.

Authorities reported that the accident occurred on a recent Tuesday evening when the 62-year-old driver was southbound on the interstate. He reportedly veered off the roadway and onto the right shoulder. He smashed into another vehicle that was stationary on the shoulder where its driver was changing a flat tire. This driver was struck and died at the accident scene.

The impact of the crash pushed the stationary car into the traffic lanes, and the car that smashed into it rolled over and came to rest on its roof, blocking traffic. This car's driver suffered a contusion to his head and reported back pain. He was arrested, and it was reported that investigators learned at a later stage that the driver had been under the influence of alcohol when he struck the car on the shoulder.

The legal counsel of the accused driver will likely investigate the DUI charge and the circumstances of this California driver's arrest. Exactly how and when his level of intoxication was determined will play an important part in his defense. He was arrested on suspicion of drunk driving, and the burden of proof is on the prosecution. If the prosecutors fail to prove guilt on all charges beyond a reasonable doubt, no conviction can take place.
