Driver pleads not guilty to DUI charge and vehicular homicide

One person was killed, and another one was seriously injured in a recent vehicle accident in Victorville. California Highway Patrol responded to an accident alert in the early evening of a recent Saturday and ended up arresting a man on a DUI charge. According to the crash report, a 26-year-old driver of a pickup truck struck the left rear of an ATV while attempting to pass it. The impact sent the ATV off the roadway, causing it to roll over.

The 33-year-old driver and the front seat passenger of the ATV were ejected, and, upon arrival at the scene, CHP officers found them with serious injuries. The driver was declared deceased at the accident scene, and the passenger was rushed to a medical center by helicopter. CHP officers apparently determined that the driver of the pickup truck was intoxicated at the time of the crash, and he was arrested.

He was charged with gross vehicular manslaughter and driving while intoxicated with a blood alcohol level above .08 which is the legal limit in California. At a hearing three days after the accident, the pickup truck driver pleaded not guilty to all charges. He was booked into a detention center where he is awaiting his next hearing.

To make sure his legal rights are protected throughout any legal proceedings that may follow, this man may want to retain the services of an experienced DUI defense attorney. An attorney can determine whether the man's legal rights were compromised during the determination of his blood alcohol level that led to the DUI charge and address any wrongdoing in court. Any accused person remains innocent until the prosecution has proved guilt beyond a reasonable doubt. A lawyer can provide an effective defense and ensure the fair treatment of the accused client throughout all proceedings with the ultimate aim of obtaining a suitable outcome.
