Driver arrested on suspicion of DUI charge after worker's death

A 21-year-old Caltrans subcontractor recently lost his life when he was struck by a vehicle operated by a man who was suspected of driving under the influence of drugs and/or alcohol. This driver was arrested and will now face a felony DUI charge. The California Highway Patrol report indicates that the worker was doing maintenance work on the sprinklers in the median adjacent to a freeway entrance.

A CHP officer reported that a 31-year-old driver was southbound on an Escondido road on a recent Monday afternoon when he tried to get onto Interstate 15. He apparently lost control of his vehicle, and it left the roadway. The SUV rolled over the edge and down an embankment, striking the worker and then coming to a stop on its roof.

The subcontractor reportedly died on impact, and the driver suffered only minor injuries. He was arrested after being taken to a hospital. There was no information reported about the driver's level of intoxication, nor was there any mention made of toxicology tests. Nevertheless, he was reportedly detained on suspicion of felonies, including DUI and vehicular manslaughter.

When a California driver is facing a felony DUI charge, the burden of proof is on the prosecution -- as is true for anyone accused of a crime. The accused will likely benefit greatly from the guidance of an experienced DUI defense attorney to provide support throughout the legal proceedings that lay ahead. A lawyer will scrutinize the details of the accident and the subsequent arrest along with the prosecution's evidence against the accused individual. With the assistance of legal counsel, decisions can be made regarding a defense strategy that will pursue a favorable result that is consistent with the client's best interest.
