63-year-old driver faces DUI charge after major injury crash

A 63-year-old California man is in custody in lieu of $50,000 bail. He is facing a felony DUI charge after California Highway Patrol officers determined that he was driving while intoxicated when he was involved in a car accident in San Mateo County. CHP reported that the crash occurred on a recent Friday evening, causing the road to be closed for approximately 45 minutes.

According to an accident report, the accused man was driving north on Highway 1 when he veered into the opposite lane. He reportedly smashed into a southbound vehicle. Officials said the 82-year-old driver of this vehicle suffered major -- but non-life-threatening -- injuries and she was hospitalized with fractured ribs.

CHP officers determined that the northbound driver was intoxicated, and he was booked into the San Mateo County Jail. The media report made no mention of the details of how and when the driver's level of intoxication was determined, nor was the blood alcohol level published. The fact that his alleged negligence caused serious injuries to the other driver brought about the felony charge.

It is not uncommon for the California public to find an individual who is facing a DUI charge guilty long before he or she has had the opportunity to defend the charge. Any person accused of drunk driving has the right to a fair trial and is also entitled to legal counsel. An experienced DUI defense attorney can examine the charges and scrutinize the compliance with legal arrest procedures while working on a strategy to obtain the best possible outcome.
