Californian driver faces DUI charge after fatal car accident

A 30-year-old driver suspected of driving under the influence of alcohol was recently arrested at the scene of an accident. The San Diego Police Department reported that the man caused a fatal accident. He is now facing a DUI charge. The accident is said to have occurred on a local roadway on a recent evening.

Reportedly, the suspected drunk driver was eastbound when he veered across the center line. A westbound driver could not avoid the wrong-way vehicle, and a head-on collision followed. The death of the 61-year-old California driver of the westbound vehicle was pronounced by paramedics at the accident scene.

A criminal conviction on a DUI charge may remain on the person's permanent record, and it may have a detrimental impact on his or her future. However, the fact that this particular driver was arrested because he was suspected of being intoxicated does not mean he is guilty. As in any criminal case, the constitutional rights of the accused person must be observed, and any charges must be proved beyond a reasonable doubt before a conviction is possible. Specific procedures must be followed during the arrest, investigation and court proceedings.

The assistance of an experienced criminal defense attorney who focuses on protecting the rights of any California driver facing a DUI charge may be invaluable. A lawyer will scrutinize the circumstances of the arrest as compared to the specific allegations contained in the criminal charges. This is a preliminary charge, and additional charges -- such as vehicular homicide while intoxicated -- may be added if any blood-alcohol tests come back above the legal limit.
