Critically injured driver may face DUI charge after car crash

The California Highway Patrol suspects a man who was critically injured in a vehicle accident to have been intoxicated at the time of the crash. CHP said it would be seeking a DUI charge with the district attorney's office. In the meantime, the man is fighting for his life after suffering spinal injuries in the crash.

An accident report states that a 44-year-old man was northbound on Highway 1 on a recent Wednesday morning, and it is claimed that he was traveling at a high rate of speed. During preliminary investigations, it was determined that the driver veered right before overcorrecting and drifting into the lanes of the southbound traffic. In an attempt to get back into the northbound lane, he traveled right across the roadway. His vehicle became airborne, thereafter striking a fence and an embankment on the northbound side of the highway. The car reportedly flipped over and the driver was ejected; apparently, he was not wearing a seat belt.

An ambulance transported the injured man to a medical center, where he was admitted to ICU. He apparently suffered injuries to his spine, a collapsed lung, fractured ribs and several lacerations. A spokesman for the hospital reported that the man's condition was still critical on Wednesday evening. Although CHP is investigating this accident as a DUI incident, no mention was made of the driver's blood alcohol percentage or how and when any tests were conducted.

The services of an experienced criminal defense attorney can be invaluable to any California driver who is facing a DUI charge. A lawyer can examine all of the prosecution evidence, scrutinizing any procedures used to determine the level of alleged intoxication. Any factual or legal issues identified will be addressed during court proceedings while ensuring that the accused person's constitutional rights -- including the right to fair and impartial proceedings -- are upheld.
