Suspicion of DUI charge does not constitute guilt

Many times when a person is arrested on suspicion of driving under the influence of alcohol, the accused person is judged by the community and regarded as guilty long before he or she has had an opportunity to defend him or herself. So, even if charges are dropped, or the court finds the accused not guilty, his or her reputation will be tainted. Anyone facing a DUI charge in California has the right to a fair trial and also the right to an attorney.

Following a recent accident in Sonoma County, a 22-year-old man is facing a DUI charge after he was arrested on suspicion of driving while impaired. California Highway Patrol officers allege that the northbound man was weaving between the northbound and southbound lanes on a recent Saturday evening. They claim that he struck the left front of a southbound car that was driven by a 39-year-old man who had one passenger in his vehicle.

The southbound driver apparently suffered severe injuries, and he was rushed to a hospital. His passenger's injuries were less severe, and she was transported to a different hospital. The driver who is under suspicion of being impaired suffered only minor injuries. No mention was made of field sobriety tests or toxicology tests being performed after the accident and before the man was arrested.

Under California laws, any suspect will remain innocent until -- and if-- the prosecution can produce evidence to prove guilt on all charges.
