Collaborative court may help when facing a repeat DUI charge

The concept of collaborative courts in California is not new, and authorities report that significant rates of success have been obtained by drug courts. Suspicion of DUI charge does not constitute guilt

Many times when a person is arrested on suspicion of driving under the influence of alcohol, the accused person is judged by the community and regarded as guilty long before he or she has had an opportunity to defend him or herself. So, even if charges are dropped, or the court finds the accused not guilty, his or her reputation will be tainted. Anyone facing a DUI charge in California has the right to a fair trial and also the right to an attorney.

The legality of the procedures used by officials at the initial traffic stop typically forms an integral part of the defense of a DUI charge.
