California mother defending a DWI charge after daughter's death

Driving under the influence of alcohol often has devastating consequences. If a drunk driver is involved in an accident, there will not only be legal complications, but also there may be life-changing personal consequences. A 31-year-old California mother who is suspected of driving under the influence of alcohol and drugs is likely considering her options for defending herself against a DWI charge.

The mother was reportedly driving in El Cajon on a recent Saturday evening. Her children, ages 2, 3 and 10 respectively, were in the car with her when she allegedly lost control and smashed into a telephone pole. El Cajon police say the driver might have fallen asleep prior to the accident. The three children suffered severe injuries and were rushed to the hospital, where, sadly, the 3-year-old girl passed away. The driver apparently complained of pain and was also transported to a hospital.

The woman is now facing several charges, including felony child endangerment, gross vehicular manslaughter, DUI and drug possession. In addition, she was apparently driving on a suspended driver's license. The police provided no information on the methods used to determine the driver's level of intoxication, nor were there any details published about when toxicology tests were done. These details may have an impact on the impending court case.

Any driver who is arrested on suspicion of driving under the influence of alcohol and/or drugs in California will be presumed innocent until and unless proved guilty. Although accused individuals will be given a fair opportunity to defend themselves against the accusations of the prosecutors, they will likely benefit from seeking assistance from experienced attorneys.
