Driver pleads not guilty to DUI charge and child endangerment

If caught driving under the influence of alcohol or drugs in California, the consequences can be devastating. If convicted, penalties may include license suspension, community service, fines and even incarceration. If there were underage children in the vehicle at the time of a DUI arrest, prosecutors may add child endangerment charges to the DUI charge that can result in additional jail time.

The California Highway Patrol reportedly arrested a 26-year-old woman just before midnight on a recent evening. She was pulled off the road for reckless driving after officers observed her allegedly exceeding the speed limit and changing lanes in an unsafe manner. When they approached the car, the officers reportedly noticed that there were three children with her, one of whom was a 6 year old who was not restrained in a child seat.

CHP officers alleged that, upon further observation, it became evident that she was under the influence. The driver was arrested and held at a detention center where bail was set at $35,000. She pleaded not guilty to charges of child endangerment and DUI at a preliminary hearing. It was not disclosed how or when it was determined that her blood alcohol content exceeded the legal limit of .08 percent.
