DUI charge may follow rear-end accident on California Interstate

California drivers who are suspected of driving while intoxicated and causing severe personal injury in an accident may have to face serious charges. A father recently described the trauma his family went through when their vehicle was rear-ended by a suspected drunk driver.

The family was returning to San Bernardino after a vacation on a recent evening when the father looked in his rearview mirror and noticed another vehicle approaching at an extremely high rate of speed. His attempt to avoid a collision failed, and the other car smashed into the rear of his. The impact caused his vehicle to roll repeatedly until it came to a halt against a guard rail.

He was shocked to discover that both of his small children had been ejected from the car during the accident, and he ran down the dark highway, looking for them. His 2-year-old daughter was found with minor injuries, and both his wife and he continued searching for their 3-year-old son. When they ultimately located him, they were happy to see movement. After being taken to the intensive care unit of a local hospital, the boy is receiving treatment for head and eye injuries, and a fractured elbow.

The media report made no mention of any charges filed, but they will likely follow. A California person facing a DUI charge may want to retain a legal representative to explain the details of each charge and clarify the legal rights and defense options that may be available. Being charged does not necessarily lead to a conviction, and the suspected DUI driver will have the opportunity to challenge the evidence presented by prosecutors.
