5 years in jail for father guilty of driving under the influence

California drivers who threaten the lives of minor passengers by driving while intoxicated can expect the wrath of the law. A father of two young girls was recently jailed for five years after he lost control of his SUV while both children were inside. The accident which led to his driving under the influence conviction occurred in August of last year.

The court documents state that the man failed to control his SUV in a turn and caused it to roll over. The driver and both children were uninjured, but deputies found the father to be intoxicated, and he was arrested. In November, the 46-year-old father pleaded guilty to felony endangerment of minors, along with misdemeanor DUI. His driver's license was found to have been revoked at the time of the accident, and that was added as an additional misdemeanor charge.

Additional information showed that the driver was on probation, following a March conviction for misdemeanor DUI. This, along with a 2011 misdemeanor DUI conviction, and felony spousal abuse conviction may have played a role in the sentence he received. The severity of a DUI conviction may be influenced by previous convictions.

California drivers who face misdemeanor charges after driving under the influence may not recognize the seriousness of the charge and be tempted enter a guilty plea.
