Driver faces felony DUI charge after fatal cross-over accident

Driving under the influence of alcohol in California can have long term consequences. Many drivers are not familiar with California's complex DUI laws, and they may not know their legal rights when they are arrested. Motorists who are facing a DUI charge may find comfort in knowing that all is not lost. They will have the opportunity to defend the charges in court and are entitled to obtain legal counsel to represent them.

After a recent head-on collision in San Diego, a 41-year-old woman is suspected of driving while impaired. The California Highway Patrol reported that she allegedly veered across the center of the road while traveling on State Route 76. Her front seat passenger apparently suffered severe injuries in the collision that followed, and a 50-year-old woman who was a passenger in the back seat of her car lost her life in the accident.

CHP reported that the 21-year-old woman who was the driver of the other vehicle was also transported to the hospital for treatment of severe injuries. The suspected DUI driver, who was also hospitalized, was arrested and will likely be facing charges related to felony DUI upon her release from the hospital. The fatal accident occurred at about 6 a.m. on a recent December morning.

When facing a DUI charge in California, the accused person may find it difficult to navigate the criminal process and decide what actions to take. With the guidance of an attorney, a defense strategy will be devised in an attempt to obtain the best possible outcome. A person accused of DUI remains innocent before the court until and unless prosecutors prove his or her guilt beyond a reasonable doubt.
