California bicycle rider facing DUI charges after accident

California residents may think DUI charges only stem from driving an automobile, but a recent story making headlines proves otherwise. Recently, a woman riding her bicycle struck a man and she is now facing DUI charges. Although the seriousness of the charges is undeniable, all facts in this case could prove to be important moving forward.

The 24-year-old woman had been riding her bicycle around a lake prior to a 4th of July fireworks show. She hit a 46-year-old man who has since died as a result of the injuries he received from the accident. At the time of the accident, he was taken to a local hospital and later transferred to another hospital for what was reported as head injuries.

The woman was arrested at the scene of the accident for suspicion of driving under the influence. No information was given as to any sobriety tests that were given or if blood samples were taken. A blood-alcohol level also was not given. Therefore, although this is no doubt a terrible tragedy, it is important to note that the arrest was made merely on suspicion of intoxication and an investigation is still ongoing.

Any California resident facing DUI charges may want to look into their rights under the applicable state laws. Taking a proactive approach could prove to be important when facing serious charges.
