California accident: driver facing DUI charges?

Highway 29 between Lower Lake and Kelseyville recently became the scene of a head-on collision that sent both drivers to the hospital. The extent of their injuries is not known, but the California Highway Patrol reported their injuries as being major. The driver of one of the vehicles as been arrested on DUI charges.

The man was driving a van at what police say was a high rate of speed when he lost control of the vehicle. When that happened, he ended up crossing veering into oncoming traffic and into the path of another vehicle which he hit head on. Both drivers had to be transported via helicopter to local hospitals. No details concerning their injuries or current condition has been released.

While a wreck such as this can ultimately result in serious charges, it is important to note the man was arrested on suspicion of driving under the influence and that the investigation is still underway. The report noted that both parties involved were wearing their seat belts at the time of the accident. As with any other accident, the accused in this case is due his day in court should the suspicions of the California Highway Patrol be backed up by toxicology results.

It is important to keep in mind that it will be up to the state to prove that the individual was, in fact, intoxicated at the time of the accident. Facing DUI charges may be overwhelming to the suspected drunk driver, especially as he is recovering from the injuries he sustained in the accident. Having the opportunity to review the evidence against him and prepare a defense will hopefully help to put the man's mind at ease as he goes through this process.
