Inability to monitor the road could affect DUI charges

It is important for individuals to be aware of their surroundings while they are driving. Following the speed limit and obeying traffic laws is helpful, too. In any circumstance, defendants should be aware that if they have a history dealing with the court system they may have to make an effort to protect their right to a fair trial in California. In the case of drunk driving investigations, certain behaviors can sometimes be interpreted as evasive and affect DUI charges.

At the beginning of January, a driver was arrested by the police in what they consider to be an evasion of police pursuit. The driver was spotted driving in a manner that the police found to be irregular. They say he was swerving in the lanes of State Route 163 in Southern California. They attempted to pull him over but claim that he did not stop driving.

They followed him as he continued to drive. While he was driving the speed limit, he did not respond to their further attempts to pull him over. Instead, they apprehended him when he stopped to get out of the car at a red light. There is no indication that his exiting the car was in response to their hails.

The so-called 'chase' ended with him being charged with drunk driving as well as a misdemeanor of evading the police. His case is made more difficult by the fact that he had a history of DUI charges. The police in California theorize that he may have been too drunk to be aware that they were following him, but that is speculation on their part. While there were likely sobriety tests in the course of the incident, there is no indication of the results. It is good to keep in mind that it may take additional effort to get a fair hearing when a defendant has a history with the court system.
