Felony DUI charges may be filed in Alameda County accident

A recent California accident has resulted in the death of a 66-year-old man. The Alameda County District Attorney's Office is investigating the accident, which involved a motorcycle and a pedestrian, to determine whether charges will be filed. If so, the driver of the motorcycle may face gross vehicular manslaughter and felony DUI charges.

According to police, the motorcyclist was traveling at a high rate of speed when it struck a man walking on the roadside. The motorcyclist, a 26-year-old man, was traveling on Jackson Street eastbound when the accident occurred. The pedestrian was found in the intersection near Jackson Street and Silva Avenue, where it is believed that he was crossing Jackson Street. Police believe that the man was within the crosswalk at the time of the accident but that has not been confirmed.

The motorcyclist was thrown from the bike and sustained minor injuries. After being treated and released from the hospital the following day, he was arrested on suspicion of gross vehicular manslaughter and felony DUI. Early reports do not indicate the results of any Breathalyzer or blood tests conducted to check for BAC levels. The results of such tests will be key if prosecutors are going to prove the man was intoxicated at the time of the accident.
